When Life Insurance Company Delays or Denies Your Claim

Like any other insurance company, life insurance companies are in business for one reason - profit. And while there is nothing wrong with trying to make an honest profit, a life insurance company owes the policyholder the benefit of the bargain upon entering into an agreement or contract with the individual policyholder. If the policyholder holds up his or her end of the bargain by timely paying the insurance premiums, the life insurance company must live up to their end of the bargain and pay the beneficiaries upon a policyholder's passing.

A life insurance company may attempt to delay or deny an insurance claim citing a material misrepresentation by the policy holder, whether alleging such misrepresentation occurred as part of the policy application or at some later time. The question of whether a misrepresentation is "material" is obviously central to the legitimacy of any delay or denial by a life insurance company. There are, of course, instances where a person's concealment of certain biographical facts may be considered a material misrepresentation (for example, policyholder denied in application for life insurance ever smoking when in fact the person smoked three packs a day for 20 years and subsequently died of lung cancer). In such instances, the life insurance company would have a legitimate reason to deny a life insurance claim.
