Claims Under Uniform Commercial Code (UCC) 4 & 4A - Bank Fraud Disputes
As the pace of our business world has grown ever faster and more efficient with the aid of technology, banking transactions have changed dramatically in the last 20 years. Modern business transactions operate with fewer boundaries, and consequently, bank transfers, including wire transfers, are made at such a rapid pace that mistakes are inevitably made by banks. when a bank fails to follow its own internal safety guidelines and/or neglects to utilize required security procedures, it may be in violation of both contractual and statutory duties, including requirements mandated under the Uniform Commercial Code (e.g. UCC 4 & UCC 4A).
It is not uncommon for individuals and companies based in Mexico, Central America, South America or other areas outside Texas or the United States, to maintain bank accounts (personal and commercial) in U.S. banks, including Texas banks.
An account holder typically enters into Deposit Agreement with his or her bank. The Deposit Agreement generally sets forth many of the responsibilities of the bank and account holders. Bank withdrawals and wire transfers are typically governed by the UCC. Section 4 discusses deposits and withdrawals. Section 4A addresses the mutual obligations of the bank and account holder involving wire transfers.
